• AN ORDINANCE AFFIRMING THE CREATION OF A SPECIAL ASSESSMENT DISTRICT PURSUANT TO §$15.1-239 ET SEQ. OF THE CODE OF VIRGINIA; ESTABLISHING THE PORTION OF PROJECT COSTS TO BE LEVIED AS AN ASSESSMENT ON THE PROPERTIES IN SUCH DISTRICT; RECITING THE FINDINGS OF CITY COUNCIL IN REGARD TO THE BENEFITS ACCRUING TO PROPERTIES WITHIN SAID DISTRICT; ESTABLISHING THE AMOUNT OF THE ASSESSMENT TO BE LEVIED ON EACH SUCH PROPERTY; LEVYING SAID ASSESSMENTS AND PROVIDING FOR THE TIME, MANNER AND TERMS OF THE COLLECTION THEREOF BE IT ORDAINED by the Council of the City of Charlottesville: SECTION 1. The action of City Council taken at a special meeting of July 8, 1974, creating a special assessment district comprising all proper- ties abutting on Main Street between the easterly margin of First Street and the westerly margin of Sixth Street, N. E., is hereby ratified and affirmed. SECTION 2. The Council finds and declares that the total cost of the improvements to Main Street and Second Street, N. E., including the construction or replacement of sanitary and storm water sewer facilities, the replacement of street and sidewalks with special paving materials, and the installation of lighting and other permanent amenities including but not limited to benches and other waste receptacles, is in excess of $2,000,000, and that $499,99.50 of such total cost may lawfully be and should be apportioned to and assessed against the parcels of real property and improvements thereon abutting such improvements and comprising such district. SECTION 3. The Council finds and declares that such improvements have benefitted and will continue to benefit the properties comprisinq such special assessment district by preserving or enhancing the values of such properties, that the benefits thus accruing to such properties are directly proportional to the assessed value of such properties, and that the amounts specified by Section 4 of this ordinance to be assessed against each such property in no case exceed the peculiar benefit accruing to such property from the improvements. SECTION 4. The sum of $499,999.50 is hereby levied as a special assessment for local improvements upon the properties comprising the special assessment district referred to in Section 1 of this ordinance.
