• AN ORDINANCE TO AMEND ARTICLE III <br />OF CHAPTER 16 OF THE CODE OF THE <br />CITY OF CHARLOTTESVILLE, 1976, <br />BY ADDING A SECTION 16-43.1 RELATING <br />TO PARKING MOTOR VEHICLES IN PARKING SPACES <br />RESERVED FOR THE HANDICAPPED. <br />BE IT OREAINED by the Council of the City of Charlottesville that <br />Article III of Chapter 16 of the Code of the City of Charlottesville, 1976, <br />be amended by adding a §16-43.1, as follows: <br />SECTION 16-43.1. Parking in spaces reserved for the handicapped. <br />(a) The city manager and traffic engineer may designate spaces on <br />the streets and other public parking lots of the city to be reserved for the <br />exclusive use of handicapped drivers. It shall be unlawful for any person <br />to park a motor vehicle in such space, who has not been issued a special <br />decal or license plates by the commissioner of motor vehicles pursuant to <br />§§46.1-104.1 or 46.1-149 of the Code of. Virginia, 1950, as amended, and <br />whose vehicle is not displaying such special plates or decals. <br />(b) Persons who have been issued such special plates or decals by the <br />• commissioner of motor vehicles shall be permitted to park their vehicles <br />displaying such plates or decals in disregard of the provisions of §516-35 <br />and 16-45(a) of this Article, but shall comply with all other provisions of <br />this Article in the same manner as any other persons are required to comply <br />therewith. <br />(c) Any police officer may issue a summons to the non -handicapped <br />operator of a motor vehicle parked in parking spaces reserved for the <br />handicapped at privately owned shopping centers and business offices with- <br />out the necessity of warrant's being obtained by the owner or other person <br />in control of such property. <br />Copy Teste: <br />0 <br />Clerk <br />Adopted by the Council <br />November 15, 1976 <br />
