Pg. 6 <br />(a) The deterioration of exterior walls or other vertical supports; <br />(b) <br />The deterioration of roofs or other horizontal members; <br />(c) <br />The deterioration of exterior chimneys; <br />• (d) <br />The deterioration or crumbling of exterior plaster or mortar; <br />(e) <br />The ineffective waterproofing of exterior walls, roofs and <br />foundations, including broken windows or doors; <br />(f) <br />The peeling of paint, rotting, holes and other forms of decay; <br />(g) <br />The lack of maintenance of surrounding environment e.g, fences, <br />gates, sidewalks, steps, signs, accessing structures and <br />landscaping; <br />(h) <br />The deterioration of any feature so as to create or permit the <br />creation of any hazardous or unsafe condition or conditions. <br />The enforcing officer shall give notice After-netsee; by certified or <br />registered mail by-the-en€ere}ag-e€Beer; of specific instances of failure <br />to maintain or repair. The owner or person in charge of such structure <br />shall have sixty days to remedy such violation.-_ provided that the Board of <br />Architectural Review, upon request may allow an extension of up to sixty days <br />to remedy such violations. Thereafter, each day during which there exists any <br />violation of this section shall constitute a separate violation and shall <br />be punishable as provided in article XXVIII of this chapter. <br />Section 31-146. Permit required; prerequisites to issuance. <br />No improvement, structural or otherwise, 3n-the-Arekiteetnra�-Bessgn <br />• Eentre�-Btstriet to any property covered shall be located, constructed, <br />reconstructed, altered, repaired or demolished unless a permit therefor is <br />issued by the zoning administrator. No such building permit shall be <br />issued by the zoning administrator unless: <br />(a) A certificate of appropriateness has been issued for the purpose <br />by the board of architectural review to the owner thereof; and <br />(b) The location, construction, reconstruction, alteration, repair <br />or demolition thereof otherwise complies with the requirements of the <br />Virginia Uniform Statewide Building Code and other ordinances and laws <br />applicable and relating thereto except, as otherwise provided in this <br />article. <br />Section 31-147.1. Appeals. <br />(a) Any decision of the Board of Architectural Review may be appealed <br />to the City Council. The decision of City Council may thereafter be <br />appealed to the Circuit Court for review by the owner (or his agent) of the <br />property for which the decision was sought or any adjacent property owner. <br />The appealing body shall file a petition at law, setting forth the alleged <br />illegality of the action taken, and shall be filed within thirty days <br />after the final decision has been rendered. <br />• <br />
