• AN ORDINANCE <br />TO AMEND AND REORDAIN SECTION 24-1.1 <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976 <br />RELATING TO THE MORATORIUM ON <br />SANITARY SEWER CONNECTIONS IN THE <br />MOORE'S CREEK DRAINAGE BASIN <br />1. Be it ordained by the Council of the City of Charlottesville <br />that Section 24-1.1 of the Code of the City of Charlottesville, <br />1976 be amended as follows: <br />SECTION 24-1.1. Moratorium on certain new sewer connections. <br />Notwithstanding any other provision of this chapter, the <br />director of public works shall not permit any connection to be <br />made to any sanitary sewer line flowing into the Moore's Creek <br />Sewage Treatment Plant, nor shall the director of finance accept <br />any application for such a connection, after 5:00 p.m. on July <br />2, 1976. Provided, however, that such moratorium on new <br />connections shall not be deemed to prohibit the connection to <br />the sanitary sewer system of any building: <br />• (1) Which is a replacement for a building which had <br />an active city sewer connection in the Moore's Creek <br />drainage area in service as of July 2, 1976, and for <br />which the director of public works certifies that the <br />sewage flow from the new building will be comparable <br />to that of the old building; or <br />(2) for which an application for a building permit, <br />conditioned upon a connection to the sanitary sewer, <br />had been granted or was pending as of 5:00 p.m. on <br />July 2, 1976; or <br />(3) which are certified by the Charlottesville - <br />Albemarle Health Department to be necessary to eliminate <br />an existing public health hazard. <br />Provided that the director of finance may accept payment for <br />sanitary sewer connections to be installed but not actually <br />connected on properties where a septic system approved by the <br />Charlottesville -Albemarle Health Department is installed as an <br />interim measure to permit construction, pending repeal of this <br />ordinance, if such property owner agrees to discontinue use of <br />• such septic system as soon as this ordinance is repealed and <br />connection to the sanitary sewer system is permitted by the city. <br />
