• <br />• <br />AN ORDINANCE TO AMEND AND REORDAIN <br />SECTION 9-1 OF CHAPTER 9 OF THE <br />CODE OF THE CITY OF CHARLOTTESVILLE, 1976, <br />RELATING TO LAND DISTURBING ACTIVITIES FOR <br />WHICH EROSION AND SEDIMENT CONTROLS ARE REQUIRED. <br />BE IT ORDAINED by the Council of the Citv of Charlottesville that <br />S9-1 of the Code of the Citv of Charlottesville, 1976, be amended and <br />reordained as follows: <br />SECTION 9-1 <br />Definitions. <br />Land disturbing activity. Any land change which may result in soil <br />erosion from water or wind and the movement of sediments into waters or <br />onto lands in the citv or adjacent jurisdictions, including, but not <br />limited to, clearing, grading, excavating, transporting, and fill of land, <br />other than federal lands, except that the term shall not include: <br />(a) Such minor land disturbing activities as home gardens and <br />individual home landscaping, repairs and maintenance work; <br />{b}--�ndiefdna}-sere#ee-eenaeetfens-en&-eeastreetten-er- <br />sxete�}at}en-ef-anbl4e-tit ility-}xaes; <br />(bl) Construction, installation, or maintenance of electric and <br />telephone utility lines; <br />(b2) Installation, maintenance or repair of any other under- <br />ground public utility mains or lines when such activity occurs <br />on an existing hard surfaced road, street or sidewalk and the <br />land disturbing activity is confined to the area of the road, <br />street or sidewalk which is hard surfaced; <br />(b3) Construction, installation, maintenance or repair of any <br />type of individual utility service connections. <br />COPY TESTE: <br />CLERK <br />ADOPTED BY THE COUNCIL <br />.JULY 18, 1977 <br />
