r <br />AN ORDINANCE <br />• TO AMEND AND REORDAIN SECTIONS 31-99, 31-100, and 31-106 <br />OF THE CODE OF THE CITY OF CHARL=SVILLE, 1976, <br />AS AMENDED, RELATING TO USES ALLOWED BY SPECIAL PERMIT <br />AND BY RIGHT IN B-4 BUSINESS DISTRICTS AND M-1 <br />RESTRICTED INDUSTRIAL DISTRICTS <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia, that <br />Sections 31-99, 31-100 and 31-106 of the Code of the City of Charlottesville, 1976, <br />as amended, be amended and reordained as follows: <br />ARTICLE XII. B-4 BUSINESS DISTRICT. <br />Division 2. Use Regulations <br />Section 31-99. Division content. <br />The following uses shall be permitted by right in the B-4 District: <br />(a) Any use permitted by right in the B-3 Business District. <br />(b) Warehouses and indoor storage areas when either is used <br />with retail or wholesale us'nesses o eratin on the same <br />CE) rating anpublishing esta 1s ents. <br />(d)--Manrnfaetnring-and-preeessing-establishmnts-e€-era€E-natrire. <br />Section 31-100. Same - With special use permit. <br />The following uses may be permitted with a special use permit in the B-4 District. <br />(a) Residential high density up to one hundred twenty dwelling units per acre <br />subject to regulations as set forth in article V. <br />(b) Public utility facilities. <br />(c) Dry cleaning establishments of moderate of high hazard, as defined by the <br />Virginia Uniform Statewide Building Code. <br />(d) Animal shelters, boarding or breeding facilities with outside runs or pens. <br />(e) Animal hospitals without outside runs or pens. <br />(f) Warehouses not used in connection with retail or wholesale businesses <br />on the same premises. <br />Jg) Ffanutacturing and processing establishments of a craft nature. <br />Section 31-106. Permitted uses - By right. <br />The following uses shall be permitted by right in the M-1 District: <br />(a) Any use permitted by right in the B-4 Business District; however, no dwelling <br />unit shall be erected or placed in any block or tract within the M-1 Restricted In- <br />dustrial District unless thirty percent or more of the area in such block or tract is <br />occupied by dwellings. <br />(b) Beverage or food processing, packaging and bottling plants. <br />(c) Assembly plants. <br />(d) Dry cleaning establishments of moderate or high hazard as defined in the <br />Virginia Uniform Statewide Building Code. <br />(e) Research and testing laboratories. <br />(f) Nurseries. <br />(g) Manufacture of rugs, mattresses, pillows, quilts, millinery, hosiery, <br />
