0 <br />AN ORDINANCE <br />TO AMEND AND REORDAIN SECTIONS 10-25 AND 10-63, <br />AS AMENDED, OF THE <br />CODE OF THE CITY OFCHARLOTTESVILLE, 1976, <br />RELATING TO PENALTIES AND INTEREST ON DELINQUENT TAXES. <br />1. BE IT ORDAINED by the Council of the City of Charlottesville <br />that 5510-25 and 10-63, as amended, of the Code of the City of <br />Charlottesville, 1976, are hereby amended and reordained as follows: <br />Section 10-25. Penalties. <br />Any person failing to pay taxes on personal property, machinery <br />and tools, and merchant's capital, on or before the fifth day of <br />December, shall incur a penalty thereof of ten percent, which shall <br />be added to the amount due from such taxpayer. Likewise, any person <br />failing to pay that portion of the taxes on real estate due on or <br />before the fifth day of June and the fifth day of December, respec- <br />tively, shall incur penalties thereon of ten percent of the amount of <br />tax respectively becoming payable on such dates. Such taxes and <br />. penalties, when collected by the city treasurer, shall be accounted <br />for in his settlements. <br />Should such taxes and penalties remain uncollected, there shall <br />be collected interest at the rate of eiffht ten percent upon both the <br />principal sum and penalties. Such interest shall commence from the <br />thirty-first day of December with regard to taxes payable December 5, <br />and from the thirtieth day of June with regard to taxes payable June <br />5. All such penalties and interest shall be collected and accounted <br />for by the city treasurer along with the principal of such taxes. <br />Section 10-63. Interest and penalty. <br />If any person, whose duty it is to do so, shall fail or refuse <br />to make such report and remit such tax as required by this article <br />within the time and in the amount required, there shall be added <br />to such tax by the commissioner a penalty in the amount of five <br />percentum of such tax, or a minimum of two dollars, if such failure <br />is for not more than thirty days duration, and thereafter interest <br />shall be payable on such overdue tax in the amount of six ten <br />percentum per annum. <br />Adopted by Council <br />February 17, 1981 <br />• Acopy attester <br />Clerk of Council <br />
