Pg. 6 <br />• a report on his or her personal efforts toward rehabilitation, along <br />with a written statement attesting to the fact that there has been no <br />change in his or her condition which could result in any adjustment <br />to or cessation of his or her disability retirement allowance or <br />partial disability benefit, or describing any such change which the <br />beneficiary believes has taken place. The commission may also require <br />the beneficiary to submit a copy of his or her personal and/or business <br />federal income tax return for the preceding year or a sworn statement <br />listing all of his or her income from employment or working, including <br />self-employment, during such year. Notwithstanding such annual report- <br />ing as may be required by the commission, it shall be the duty of any <br />beneficiary of a disability retirement allowance or a partial dis- <br />ability benefit to notify the commission within thirty days of any <br />material change in his or her medical condition, or of any gainful <br />occupation or work in which he or she becomes engaged. Failure of the <br />beneficiary to furnish the information required by the commission <br />under this subsection in a timely manner or failure of the beneficiary <br />to cooperate with vocational rehabilitation counselors in order to <br />derive maximum benefit from rehabilitation services offered at <br />employer expense, shall constitute grounds for the commission to <br />deny or order cessation of the disability retirement allowance or to <br />deny or order a reduction or cessation of the partial disability <br />• benefit to such beneficiary. <br />2. That this ordinance shall apply totally to all plan members by <br />whom or for whom disability retirement is sought after its effective <br />date. <br />3. That all persons currently retired for disability under this plan, <br />and all plan members by whom or for whom disability retirement is <br />currently being sought or may be sought in the future will be subject <br />to the annual review procedures established by this ordinance, and <br />as a result of such review, may be subject to cessation of a disability <br />retirement allowance, conversion to a partial disability benefit, or <br />cessation or adjustment of a partial disability benefit, as provided <br />in this ordinance. <br />Adopted by Council <br />August 17, 1951 <br />• Atteste: <br />Clerk of Councl-f--- <br />
