• AN ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />AN ALLEY CONNECTING FORREST STREET AND ALBEMARLE STREET <br />WHEREAS, proper notice that Electronic Technologies, Inc. <br />would make application to the City Council of the City of <br />Charlottesville, to have the hereinafter described alley closed, <br />vacated and discontinued was duly posted and advertised; and <br />WHEREAS, all owners abutting said alley have been duly <br />notified; and <br />WHEREAS, application was made to the City Council, and <br />pursuant to the statutes in such cases made and provided, <br />the Council appointed viewers who have reported that no <br />inconvenience would result from such closure, vacation and <br />discontinuance; now, therefore <br />BE IT ORDAINED by the Council of the City of Charlottes- <br />ville, Virginia, that the said alley located in said City, <br />described as follows, is hereby closed, vacated and discon- <br />tinued as a public thoroughfare of the City of Charlottesville, <br />Virginia, said alley not being needed for public use and <br />travel: <br />An alley, fifteen feet wide, connecting <br />Forrest Street and Albemarle Street between <br />Dale Avenue and Charlton Avenue. <br />PROVIDED, HOWEVER, that the City of Charlottesville <br />hereby reserves unto itself a perpetual easement ten feet in <br />width on either side of the centerline of the storm sewer line <br />or main presently located in the area being vacated, including <br />the perpetual right of ingress and egress over the vacated area <br />for the purpose of installing, maintaining, repairing or replacing <br />such utility line. <br />BE IT FURTHER ORDAINED that the Clerk of the Council shall <br />send a copy of this ordinance to the Clerk of the Circuit Court <br />for recordation in the current street closing book. <br />Approved by Council <br />December 3, 1984 <br />KJ/erk of Council <br />
