SECTION 8. Should the Company install any overhead <br />• lines, it shall have the authority to trim trees upon or <br />overhanging the streets, alleys, walkways or rights-of-way to <br />prevent the branches of such trees from interfering with its <br />lines or other facilities. However, all such trimmings shall <br />be performed in a safe and orderly manner and in compliance <br />with the pruning standards of the National Arborists <br />Association as currently in effect. <br />SECTION 9. As a franchise fee for the rights granted <br />herein the Company shall pay to the City on the date of <br />acceptance of this franchise the sum of one hundred dollars <br />($100). On that date in each succeeding year, the Company <br />shall pay to the City a sum equal to one hundred dollars <br />($100) for each mile, or fraction thereof, of overhead or <br />. underground cable in place. Such payments shall be in <br />addition to, and not in lieu of, any business license tax, <br />real or personal property tax, or other tax of general <br />application to which the Company may be subject. <br />SECTION 10. The term of this franchise shall be for a <br />period of five (5) years from the effective date of this <br />ordinance. If the Company wishes to maintain its equipment <br />within the City and to continue the operation of the system, <br />it shall give written notice to the City at least ninety (90) <br />days before expiration of the franchise, stating that it <br />wishes to apply for a new franchise. Such application shall <br />include a comprehensive report of the status of the Company's <br />system within the City, any plans for alteration, expansion <br />• or improvement of the system, and a statement as to whether <br />WE <br />
