• AN ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />LEE STREET BETWEEN <br />JEFFERSON PARK AVENUE AND ELEVENTH STREET <br />WHEREAS, proper notice that The Rector and Visitors of <br />the University of Virginia would make application to the <br />City Council of the City of Charlottesville, to have the <br />hereinafter described street closed, vacated and discontinued <br />was duly posted and advertised; and <br />WHEREAS, all owners abutting said street have been duly <br />notified; and <br />WHEREAS, application was made to the City Council, and <br />pursuant to the statutes in such cases made and provided, <br />the Council appointed viewers who have reported that no <br />inconvenience would result from such closure, vacation and <br />discontinuance; now, therefore; <br />BE IT ORDAINED by the Council of the City of Char- <br />lottesville, Virginia, that the said street located in said <br />City, described as follows, is hereby closed, vacated and <br />discontinued as a public thoroughfare of the City of Char- <br />lottesville, Virginia, said street not being needed for <br />public use and travel: <br />The entire portion of Lee Street between <br />Jefferson Park Avenue and Eleventh Street <br />for a distance of approximately 1,020 feet. <br />PROVIDED, HOWEVER, that the City of Charlottesville <br />hereby reserves unto itself a perpetual easement ten feet in <br />width on either side of the centerline of the sanitary <br />sewer line presently located in the area being vacated, <br />including the perpetual right of ingress and egress over <br />the vacated area for the purpose of installing, maintaining, <br />repairing or replacing such utility line. <br />BE IT FURTHER ORDAINED that the Clerk of the Council <br />shall send a copy of this ordinance with plat attached to <br />the Clerk of the Circuit Court for recordation in the current <br />street closing book. <br />• Approved by Council <br />July 1, 1985 <br />C rk of Council <br />85-7-25 <br />
