• AN ORDINANCE <br />TO AMEND THE ZONING DISTRICT MAP INCORPORATED <br />BY REFERENCE IN SECTION 31-4 OF THE <br />CODE OF THE CITY OF CHARLOTTESVILLE, 1976, <br />AS AMENDED, BY CHANGING TO THE PLANNED UNIT DEVELOPMENT <br />(PUD) ZONING CLASSIFICATION PROPERTY KNOWN AS <br />THE MCINTIRE SCHOOL SITE. <br />BE IT ORDAINED by the Council of the City of <br />Charlottesville: <br />1. That the zoning district map, incorporated by <br />reference in Section 31-4 of the Code of the City of <br />Charlottesville, 1976, as amended, be amended by designating <br />as a Planned Unit Development zoning classification that lot <br />or parcel of land known as the McIntire School property <br />fronting on U.S. 250 Bypass, Birdwood, Edgehill, and <br />Hillcrest Roads, designated as Parcels 7 and 16 on City Real <br />Property Tax Map 45, and containing approximately 315,500 <br />square feet of land (7.24 acres), and 198,416 square feet <br />(4.55 acres) respectively. <br />2. That such amendment be conditioned upon the <br />• following: <br />(a) That the property be developed with not more than <br />30 single family -attached residential units, designed for <br />sale as condominiums on parcel 45-16 and not more than 25 <br />multi -family condominium units on parcel 45-7. <br />(b) That the development of such property be carried <br />out in conformity with the plans for development and related <br />documents and exhibits submitted as part of the application <br />for the PUD zoning designation, including such modifications <br />to such plans as may be required by the city planning <br />commission or the director of planning for final approval <br />thereof. <br />(c) That the appropriate documents for formation or <br />incorporation of a homeowners' association, for ownership and <br />maintenance of common spaces and facilities be submitted for <br />review and approval by the city attorney and the department <br />of community development prior to final site plan approval. <br />(d) That development and construction on the property <br />be carried out in conformity with all other applicable <br />federal, state or city code requirements and regulations. <br />.
