Section 25-59. Suspension and revocation. <br />Any permit issued under this article may be revoked or <br />suspended by the zoning administrator after a hearing con- <br />ducted pursuant to written notice delivered to such vendor's <br />place of business or mailed to such vendor's last known <br />address, at least five days before such meeting, if the <br />zoning administrator finds any of the following causes: <br />(a) Fraud or misrepresentation contained in the application <br />for the permit; <br />(b) Fraud or misrepresentation made in the course of <br />the vending operation; <br />(c) Conduct of the vending operation in a manner <br />contrary to the conditions of the permit or any required <br />certificate of appropriateness; <br />(d) Conduct of the vending operation in such manner as <br />to create a public nuisance or constitute a danger to the <br />public health, safety or welfare; or <br />. (e) Conduct which is contrary to the provisions of <br />this article or any other law or regulation applicable to <br />the vending operation. <br />Section 25-60. Appeals. <br />Persons who are denied permits or whose permits are sus- <br />pended or revoked by the zoning administrator may appeal <br />in writing within ten days to the City Council, setting <br />forth fully their grounds of appeal. City Council review <br />shall be de novo and shall occur no later than the second <br />regularly scheduled Council meeting following submission of <br />the written appeal. <br />Section 25-61. Penalty. <br />Any person violating any provision of this article <br />shall be guilty of a Class III misdemeanor and, upon con- <br />viction, shall be punished in accordance with the range of <br />Class III misdemeanor penalties described in section 1-10 of <br />this Code. <br />2.
