AN ORDINANCE • CLOSING, VACATING AND DISCONTINUING A PORTION OF AN ALLEY OFF RIDGE STREET WHEREAS, proper notice that Oakwood Land Trust would make application to the City Council of the City of Charlottesville, to have the hereinafter described alley closed, vacated and discontinued was duly posted and advertised; and WHEREAS, all owners abutting said alley have been duly notified; and WHEREAS, application was made to the City Council, and pursuant to the statutes in such cases made and provided, the Council appointed viewers who have reported that no inconvenience would result from such closure, vacation and discontinuance; now, therefore BE IT ORDAINED by the Council of the City of Charlottesville, Virginia, that the said alley located in said City, described as follows, is hereby closed, vacated and discontinued as a public thoroughfare of the City of Charlottesville, Virginia, said alley not being needed for public use and travel: • That portion of an alley located on the southeast side of Ridge Street between 512 and 516 Ridge Street beginning approximately 193 feet from the curb cut at Ridge Street and extending to the alley's terminus. PROVIDED, HOWEVER, that the City of Charlottesville hereby reserves unto itself a perpetual easement ten feet in width on either side of the centerline of any water, sanitary sewer and storm sewer lines or mains presently located in the area being vacated, including the perpetual right of ingress and egress over the vacated area for the purpose of installing, maintaining, repairing or replacing such utility lines. BE IT FURTHER ORDAINED that the Clerk of the Council shall send a copy of this ordinance to the Clerk of the Circuit Court for recordation in the current street closing book.
