AN ORDINANCE VACATING AND <br />DISCONTINUING A SUBDIVISION PLAT <br />• OF SEMINOLE SQUARE <br />WHEREAS, there has been recorded in the Clerk's Office of the Circuit <br />Court of this City in Deed Book 433, page 334, a plat prepared by William S. <br />Roudabush, Inc. dated March 22, 1982 entitled "Subdivision Plats Seminole <br />Square", and there was also recorded in such Clerk's Office in Deed Book 433, <br />page 321 a plat of William S. Roudabush, Inc. dated September 1, 1982 entitled <br />"Dedication of Streets and Easements Seminole Square", both of which plats <br />purport to dedicate to public use certain streets, storm sewer drainage water <br />and gas line easements shown thereon; and <br />WHEREAS, §15.1-478 of the Code of Virginia (1950, as amended) provides <br />the recordation of such plats operates to transfer in fee simple to the city <br />such portion of the premises shown on such plats as were set apart for streets, <br />easements or other public use; and <br />• WHEREAS, because of proposed new development within the areas shown on <br />such plats, it became desirable to change the location of certain of the <br />streets and easements which were shown on such plats and dedicated to public <br />use; and <br />WHEREAS, a revised subdivision plat made by William S. Roudabush, Inc., <br />dated December 3, 1984, last revised December 10, 1984 has been recorded in <br />such Clerk's Office in Deed Book 458, pages 687-687A. which plat shows, inter <br />alia, a parcel identified as "Release Parcel E", which is shown thereon for <br />the sole purpose of identifying property to be conveyed by Clay Petyon and <br />others, and is not intended to release, alter or otherwise affect any of the <br />roads, easements or other features shown or described in plats or agreements <br />affecting Seminole Square previously of record, and which is to be totally <br />disregarded for the purpose of this Ordinance; and <br />
