AN ORDINANCE <br />TO AMEND AND REORDAIN ARTICLE II OF CHAPTER 25 <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, AS AMENDED, <br />BY REPEALING SECTIONS 25-29, 25-30, 25-32 AND 25-34 <br />REGARDING EXCAVATIONS IN PUBLIC WAYS <br />AND BY ADDING NEW SECTIONS 25-29.1, 25-30.1, 25-30.2, 25-32.1, <br />25-34.1, 25-34.2, 25-34.3 AND 25-34.4 <br />TO ESTABLISH PERMIT, FEE AND BOND REQUIREMENTS, AND <br />COMPREHENSIVE PAVEMENT CUTTING STANDARDS FOR ALL / <br />EXCAVATIONS IN PUBLIC WAYS. <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia: <br />1. That sections 25-29, 25-30, 25-32 and 25-34 of the Code <br />of the City of Charlottesville, 1976, as amended, are hereby <br />repealed. <br />2. That Article II of Chapter 25 of the Code of the City of <br />Charlottesville, 1976, as amended, is hereby amended and <br />reordained by adding new sections 25-19.1, 25-30.2, 25-32.1, <br />25-34.1, 25-34.2, 25-34.3 and 25-34.4, as hereinafter set forth. <br />ARTICLE II. EXCAVATIONS IN PUBLIC WAYS <br />Section 25-29.1. Permit required <br />• (a) No person shall dig up, break, excavate, tunnel, <br />undermine or open the surface or subsurface of any street, as <br />defined in section 25-1 of this Chapter, without first obtaining <br />a permit to do so from the director of public works; nor shall <br />such work be performed after such permit shall have been revoked <br />or shall have become ineffective. <br />(b) If an excavation is required in order to make emergency <br />repairs, and the existing emergency requires that excavation <br />operations commence within seventy-two (72) hours from the <br />discovery of said emergency, a permit shall not be required to <br />commence the excavation. Any person commencing an emergency <br />excavation without a permit must: <br />1) Give notice of the nature of the emergency and the <br />need for an excavation by telephone or other means to the director <br />of public works immediately following discovery of the emergency; <br />and, <br />2) File an application, permit fee and bond, as <br />required by this article, as soon as practicable following <br />commencement of the excavation. <br />Any person commencing an emergency excavation without a <br />permit as allowed herein thereby implies acceptance of all <br />• <br />
