• AN ORDINANCE <br />TO AUTHORIZE THE RECONVEYANCE <br />OF A CEMETERY, KNOWN AS HEBREW CEMETERY, <br />LOCATED ON THE EAST SIDE OF FIRST STREET <br />IN THE CITY OF CHARLOTTESVILLE <br />TO THE TRUSTEES OF THE RELIGIOUS CONGREGATION <br />OF BETH ISRAEL TEMPLE OF CHARLOTTESVILLE, <br />AND TO RETURN TO THE CONGREGATION $4,000.00 <br />IN PERPETUAL CARE FUNDS <br />WHEREAS, in 1949, at the request of the Congregation of Beth <br />Israel Temple, the City of Charlottesville accepted the <br />conveyance of the Hebrew Cemetery on the East Side of First <br />Street in the City of Charlottesville from the Congregation, <br />along with $4,000.00 to be contributed to the perpetual <br />maintenance fund of the City, and <br />WHEREAS, the Congregation wishes to resume ownership and <br />operation of said cemetery, now, therefore, <br />BE IT ORDAINED by the Council of the City of <br />Charlottesville, Virginia, that: <br />• 1. The City Attorney's Office is hereby authorized to <br />prepare a deed to reconvey the cemetery to Trustees of the <br />Religious Congregation of Beth Israel Temple. <br />2. The deed shall provide for the return to the <br />Congregation of $4,000.00 which it contributed in 1949 <br />for perpetual care of the cemetery. <br />3. The deed shall provide that the Congregation shall <br />deposit the $4,000.00 in a perpetual care fund for the cemetery <br />and shall add to it 10% of the proceeds from sales of plots in <br />the future. <br />4. The deed shall contain other appropriate provisions as <br />negotiated between the City and the Congregation. <br />5.
