• ARTICLE I. General Provisions <br />Section 1-1. Short Title. <br />This ordinance shall be known and cited as the Multi -Channel <br />TV Cable Franchise Ordinance of 1986. Within this ordinance it <br />shall also be referred to as "the Franchise." <br />Section 1-2. Definitions. <br />For the purpose of this ordinance the following terms and <br />their derivatives shall have the respective meanings given them in <br />this section. Words not defined shall be given their common and <br />ordinary meaning. <br />A. "Act" means the federal Cable Communications Policy Act <br />of 1984, as it may be amended and in force during the term of this <br />franchise. <br />B. "Cable Communication System", or "System", means a system <br />of antennas, cables, wires, towers, waveguides or other <br />conductors, converters, and other facilities for receiving, <br />producing, transmitting, amplifying and distributing audio, video, <br />digital or other electronic signals to subscribers. This <br />definition shall not include any such system that serves only <br />• subscribers in one or more multiple dwelling units or commercial <br />properties under common ownership, control or management, and that <br />does not use City streets or other public property. <br />C. "City" means the City of Charlottesville, a municipal <br />corporation and independent political subdivision of the <br />Commonwealth of Virginia, acting by its duly elected governing <br />body, the City Council, and where so indicated, through its duly <br />appointed City Manager, City Attorney, Director of Public Works or <br />other officers or employees. <br />D. "Company" means Multi -Channel TV Cable Company doing <br />business in Charlottesville as Jefferson Cable, or its successor, <br />transferee or assignee. <br />E. "FCC" means the Federal Communications Commission and its <br />lawfully designated agents, or its successor in function. <br />F. "Gross Revenues" means all revenue collected directly or <br />indirectly by the Company, from or in connection with the <br />operation of its cable communication system within the City <br />pursuant to this ordinance, including but not limited to <br />subscriber service monthly fees, net pay television fees, <br />installation and reconnection fees, leased channel fees, converter <br />rentals, studio rental, production equipment and personnel fees, <br />and advertising revenues. Gross revenues shall not include the <br />• City's consumer utility tax on services furnished by the Company <br />which is imposed directly upon subscribers and collected by the <br />=n <br />
