impracticable, the Company may place the overhead, using the poles of other utilities where available or its own poles if • necessary. If the Director finds that underground installation is not impracticable the Company will install the proposed facilities underground at its expense. The Director shall act on the Company's requests for rulings under this subsection within thirty days of receiving them. (4) The Company shall have no obligation under subparagraph (3) above to place any of the following facilities underground: (a) facilities being replaced to restore service interrupted by ice, storm, accident, and other circumstances beyond the Company's control; (b) subscriber drops; (c) facilities of less than 300 feet in length; (d) facilities outside of the City's architectural design control districts; and (e) facilities on poles bearing communications distribution lines. Section 2-2. General Standards for Installations. A. The Company's system shall be located, erected and maintained so that none of its facilities shall endanger or interfere with the lives of persons, or interfere with any improvements the City may deem proper to make, or cause damage to the property of others. B. All facilities erected by the Company within the City shall be so located as to cause minimum interference with the proper use of streets, alleys, and other public property, and to cause minimum interference with the rights or reasonable convenience of property owners who adjoin any of those streets, alleys or other public property. C. The Company shall not place its facilities where they will interfere with any gas, electric or telephone facilities or obstruct or hinder in any manner the various utilities serving the residents of the City. Section 2-3. Permission of Others. It shall be the Company's sale responsibility to obtain and maintain in force any easements, permits, licenses or other authorizations from private property owners, the County of Albemarle, the Virginia Department of Highways and Transportation, the FCC, the Federal Aviation Administration, public utility companies and other persons, firms or governmental entities as may be required for the installation, maintenance and operation of its system in accordance with this franchise. -11-
