impracticable, the Company may place the overhead, using the <br />poles of other utilities where available or its own poles if <br />• necessary. If the Director finds that underground installation is <br />not impracticable the Company will install the proposed <br />facilities underground at its expense. The Director shall act on <br />the Company's requests for rulings under this subsection within <br />thirty days of receiving them. <br />(4) The Company shall have no obligation under subparagraph <br />(3) above to place any of the following facilities underground: <br />(a) facilities being replaced to restore service <br />interrupted by ice, storm, accident, and other circumstances <br />beyond the Company's control; <br />(b) subscriber drops; <br />(c) facilities of less than 300 feet in length; <br />(d) facilities outside of the City's architectural <br />design control districts; and <br />(e) facilities on poles bearing communications <br />distribution lines. <br />Section 2-2. General Standards for Installations. <br />A. The Company's system shall be located, erected and <br />maintained so that none of its facilities shall endanger or <br />interfere with the lives of persons, or interfere with any <br />improvements the City may deem proper to make, or cause damage to <br />the property of others. <br />B. All facilities erected by the Company within the City <br />shall be so located as to cause minimum interference with the <br />proper use of streets, alleys, and other public property, and to <br />cause minimum interference with the rights or reasonable <br />convenience of property owners who adjoin any of those streets, <br />alleys or other public property. <br />C. The Company shall not place its facilities where they <br />will interfere with any gas, electric or telephone facilities or <br />obstruct or hinder in any manner the various utilities serving the <br />residents of the City. <br />Section 2-3. Permission of Others. <br />It shall be the Company's sale responsibility to obtain and <br />maintain in force any easements, permits, licenses or other <br />authorizations from private property owners, the County of <br />Albemarle, the Virginia Department of Highways and Transportation, <br />the FCC, the Federal Aviation Administration, public utility <br />companies and other persons, firms or governmental entities as may <br />be required for the installation, maintenance and operation of its <br />system in accordance with this franchise. <br />-11- <br />
