AN ORDINANCE CLOSING, VACATING AND DISCONTINUING A PORTION OF AN ALLEY OFF EAST JEFFERSON STREET BETWEEN 3RD AND 4TH STREETS, N.E. WHEREAS, proper notice that VHM Corporation would make application to the City Council of the City of Charlottesville to have the hereinafter described alley closed, vacated and discontinued was duly posted and advertised; and WHEREAS, all owners abutting said alley have been duly notified; and WHEREAS, application was made to the City Council, and pursuant to the statutes in such cases made and provided, the Council appointed viewers who have submitted reports whether any inconvenience would result from such closure, vacation and discontinuance; now, therefore, BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the said portion of an alley located in said City, described as follows, is hereby closed, vacated and discontinued as a public thoroughfare of the City of Charlottesville, Virginia, said portion of the alley not being needed for public use and travel: • Triangular portion of property (25 square feet in area) at the end of the alley off East Jefferson Street between Third and Fourth Streets, N.E. on City Real Property Tax Map 33. PROVIDED, HOWEVER, that the City of Charlottesville hereby reserves unto itself a perpetual easement ten feet in width on either side of the centerline of any water, sanitary sewer and storm sewer lines or mains presently located in the area being vacated, including the perpetual right of ingress and egress over the vacated area for the purpose of installing, maintaining, repairing or replacing such utility lines. BE IT FURTHER ORDAINED that the Clerk of the Council shall send a copy of this ordinance with plat attached to the Clerk of the Circuit Court for recordation in the current street closing book.
