AN ORDINANCE TO AMEND • CHAPTER 21.1 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, AS AMENDED, RELATING TO PURCHASING, BY ADDING A SECTION 21.1-35.1 IN ORDER TO PROVIDE SPECIAL CONTRACT PROCEDURES FOR THE PURCHASE OF NATURAL GAS SUPPLIES. BE IT ORDAINED by the Council of the City of Charlottesville, Virginia, that Chapter 21.1 of the Code of the City of Charlottesville, 1976, as amended, be further amended by adding a section numbered 21.1-35.1, as follows: Sec. 21.1-35.1 - Special Procedures Applicable to the Purchase of Natural Gas. (a) Notwithstanding any other provision of this chapter, the City Manager is authorized to enter into contracts or to modify existing contracts with the Columbia Gas Transmission Corporation, or its successors or assigns, without competitive bidding, for the purchase of natural gas at prices established by federal regulation, or for the transportation of gas purchased from others, or for natural gas storage services. Columbia Gas Transmission Corporation, being the only interstate gas pipeline physically connected to the City's gas system is hereby found to be the sole source practicably available to the • City for such services. (b) The City Manager, or the Superintendent of the Gas Division in the Department of Public Works acting as designee of the City Manager, is hereby authorized to enter into contracts with sources other than Columbia Gas Transmission Corporation for such portions of the City's natural gas requirements as may be so obtained under existing applicable federal regulations, and for the transportation of such gas supplies by Columbia Gas Transmission Corporation and other pipelines, without competitive sealed bidding, but subject to the procedural limitations set forth in paragraph (c) below. (c) No such contract for the purchase of natural gas from sources other than Columbia Gas Transmission Corporation shall be valid unless the Director of Public Works certifies to the City Manager that the price for such gas, including applicable transportation charges, is the lowest of not fewer than three telephone price quotations obtained by the Gas Division before entering into such contract. The Gas Division shall maintain a list of all responsible bidders able to deliver natural gas supplies to the Columbia Gas system for transportation to the City, who have requested to be contacted when the City is proposing to enter into contracts for purchases of such portions of its gas supply. The bidders to be called for quotations on any one such contract shall be chosen at random • from the names on such list, provided, however, that any current supplier may be asked for a new price quotation for any renewal of such contract.
