AN ORDINANCE TO AMEND <br />• CHAPTER 21.1 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, <br />1976, AS AMENDED, RELATING TO PURCHASING, <br />BY ADDING A SECTION 21.1-35.1 IN ORDER TO PROVIDE <br />SPECIAL CONTRACT PROCEDURES FOR THE <br />PURCHASE OF NATURAL GAS SUPPLIES. <br />BE IT ORDAINED by the Council of the City of <br />Charlottesville, Virginia, that Chapter 21.1 of the Code of <br />the City of Charlottesville, 1976, as amended, be further <br />amended by adding a section numbered 21.1-35.1, as follows: <br />Sec. 21.1-35.1 - Special Procedures Applicable to the <br />Purchase of Natural Gas. <br />(a) Notwithstanding any other provision of this chapter, <br />the City Manager is authorized to enter into contracts or to <br />modify existing contracts with the Columbia Gas Transmission <br />Corporation, or its successors or assigns, without competitive <br />bidding, for the purchase of natural gas at prices established <br />by federal regulation, or for the transportation of gas <br />purchased from others, or for natural gas storage services. <br />Columbia Gas Transmission Corporation, being the only interstate <br />gas pipeline physically connected to the City's gas system is <br />hereby found to be the sole source practicably available to the <br />• City for such services. <br />(b) The City Manager, or the Superintendent of the Gas <br />Division in the Department of Public Works acting as designee of <br />the City Manager, is hereby authorized to enter into contracts <br />with sources other than Columbia Gas Transmission Corporation <br />for such portions of the City's natural gas requirements as may <br />be so obtained under existing applicable federal regulations, <br />and for the transportation of such gas supplies by Columbia Gas <br />Transmission Corporation and other pipelines, without <br />competitive sealed bidding, but subject to the procedural <br />limitations set forth in paragraph (c) below. <br />(c) No such contract for the purchase of natural gas from <br />sources other than Columbia Gas Transmission Corporation shall <br />be valid unless the Director of Public Works certifies to the <br />City Manager that the price for such gas, including applicable <br />transportation charges, is the lowest of not fewer than three <br />telephone price quotations obtained by the Gas Division before <br />entering into such contract. The Gas Division shall maintain a <br />list of all responsible bidders able to deliver natural gas <br />supplies to the Columbia Gas system for transportation to the <br />City, who have requested to be contacted when the City is <br />proposing to enter into contracts for purchases of such <br />portions of its gas supply. The bidders to be called for <br />quotations on any one such contract shall be chosen at random <br />• from the names on such list, provided, however, that any <br />current supplier may be asked for a new price quotation for any <br />renewal of such contract.
