• SECTION III. The Company shall comply with and fulfill <br />all ordinances, regulations and requirements of the City of <br />Charlottesville regarding excavatiions in public ways. <br />SECTION IV. Upon notice from the Director of Public <br />Works of a proposed improvement or alteration of City side- <br />walks, streets or other property, or of a proposed relocation <br />of any City -owned utilities, the Company shall relocate at <br />its own expense any underground or overhead lines, within <br />sixty (60) days of receipt of the notice. <br />SECTION V. The Company agrees and binds itself to <br />indemnify, keep and hold the City free and harmless from <br />liability on account of injury or damage to persons, firms or <br />corporations or property growing out of or directly or <br />Is <br />indirectly resulting from (a) such use of the streets, <br />alleys, highways, sidewalks, rights -of -ray and other public <br />places of the City, (b) the acquisition, erection, installa- <br />tion, maintenance, repair, operation and use of any poles, <br />wires, cables, conduits, lines, manholes, facilities and <br />equipment, or (c) the exercise of any right granted by or <br />under this franchise or the failure, refusal or neglect of <br />the Company to perform any duty imposed upon or assumed by <br />the Company by or under this franchise. The Company shall <br />also maintain in force a comprehensive general liability <br />policy in form satisfactory to the City Attorney of the City <br />of Charlottesville, having a combined single limit coverage <br />of not less than one million dollars ($1,000,000).
