• (e) Decisions must be made by an affirmative vote of a <br />majority of the members of the board, unless all parties agree at <br />the hearing to allow a lesser number to decide the case. <br />Sec. 5-41. Placarding of condemned building. <br />(a) Any building, wall or other structure condemned as <br />unfit for human use or habitation shall be so designated and <br />placarded by the enforcing officer; provided, however, that the <br />placarding shall not be carried out until after entry of a final <br />condemnation order and after either the end of the time for <br />appeal of such order or entry of a decision of the Building Code <br />Board of Appeals affirming or continuing such order in some form. <br />Any building, wall or other structure shall be vacated (or its <br />use discontinued) within the time specified in the final order <br />or board decision. <br />(b) The placard shall bear the following inscription: <br />"This building/vall/structure and premises are condemned as <br />unfit for human use or habitation, and the use or occupancy of <br />this building/vall/structure and premises is prohibited and <br />unlawful." <br />• (c) Upon the posting of the placard, no person shall <br />enter or use such a building, wall or other structure except upon <br />authorization of the enforcing officer for one of the following <br />purposes: <br />(i) to make the required repairs; or <br />(ii) to demolish and remove the building, wall or <br />other structure; or <br />(iii) to make inspections. <br />Sec. 5-42. Use of condemned buildings prohibited; removal <br />of placard upon compliance. <br />No building, wall or other structure which has been <br />condemned as unfit for human use or habitation shall again be <br />used or occupied until written approval is secured from, and such <br />placard is removed by, the enforcing officer. The enforcing <br />officer shall remove such placard whenever the defects upon which <br />the condemnation action was based have been eliminated. <br />Sec. 5-43. Unauthorized removal of placard. <br />It shall <br />be unlawful for any <br />person to deface or remove the <br />placard from <br />any building, wall or <br />other structure which remains <br />• <br />condemned as <br />unfit for human use <br />or habitation. <br />
