• AN ORDINANCE <br />TO AUTHORIZE THE SALE TO PAUL L. PHIPPS <br />OF PROPERTY LOCATED AT THE CORNER OF PRESTON AVENUE AND <br />FOREST STREET, IDENTIFIED AS PARCEL "A" ON THE ATTACHED SKETCH, <br />FOR $15,600.00, AND TO AUTHORIZE THE MAYOR'S SIGNATURE <br />ON THE DEED OF CONVEYANCE. <br />• <br />• <br />WHEREAS, the City of Charlottesville no longer has any use <br />for certain property which it owns on Preston Avenue, located at <br />the corner of Preston Avenue and Forest Street, and identified as <br />Parcel "A" on the attached sketch, being 3,900 square feet in <br />area; and <br />WHEREAS, Paul L. Phipps has agreed to purchase the above <br />described property for the sum of $15,600.00; and <br />WHEREAS, the purchaser has agreed to certain land use <br />restrictive covenants deemed appropriate by the City; now, <br />therefore, <br />BE IT ORDAINED by the Council of the City of Charlottes- <br />ville, Virginia that the sale of said unimproved property, as is, <br />to Paul L. Phipps for the sum of $15,600.00 is hereby authorized, <br />and the Mayor is hereby authorized to execute a quitclaim deed <br />prepared by the City Attorney's Office to close the sale, a copy <br />of which deed shall be attached to this ordinance and kept with <br />the minutes of this Council meeting. The deed shall contain <br />restrictions running with the land that limit land use <br />development in the following ways: <br />1) No buildings shall be constructed within thirty (30) <br />feet of either the Forest Street or Preston Avenue property line. <br />2) Uses of the remainder of the property hereby conveyed <br />shall be only those uses permitted as a matter of right in the B- <br />2 zoning district in the City of Charlottesville, and, with City <br />Council's express approval, those uses permitted by special <br />permit in said B-2 zone. <br />3) Parking and landscaping and any other improvements <br />constructed on the property purchased from the City shall be <br />subject to prior approval by the Director of the Department of <br />Community Development for the City under normal site plan review <br />criteria. <br />4) The following uses of the property shall no be allowed <br />in any event: retail stores, service stations, laundromats and <br />self-service cleaning establishments, car washes, and sign <br />painting. <br />Approved by Council <br />November 7, 1988 <br />qwn��� I , <br />C rk of Council <br />
