• <br />• <br />• <br />AN ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />A PORTION OF AN ALLEY OFF ROSE HILL DRIVE <br />WHEREAS, proper notice that Dr. Charles Wood, Jr., <br />Virginia Wood and Ernest Tucker would make application to <br />the City Council of the City of Charlottesville to have <br />the hereinafter described alley closed, vacated and <br />discontinued was duly posted and advertised; and <br />WHEREAS, all owners abutting said alley have been <br />duly notified; and <br />WHEREAS, application was made to the City Council, and <br />pursuant to the statutes in such cases made and provided, <br />the Council held a joint public hearing with the Planning <br />Commission on December 8, 1987, and received comments from <br />City staff, the Planning Commission and the public; now, <br />therefore, <br />BE IT ORDAINED by the Council of the City of <br />Charlottesville, Virginia that the said portion of the <br />alley located in said City, described as follows, is hereby <br />closed, vacated and discontinued as a public thoroughfare <br />of the City of Charlottesville, Virginia, said portion of <br />the alley not being needed for public use and travel: <br />That portion of a 15 foot wide alley off <br />Rose Hill Drive, running from the eastern <br />side of Rose Hill drive to a point <br />intersected by the line which separates <br />Parcel 4 and Parcel 4.1 (approximately <br />100 feet), more particularly shown on the <br />attached plat. The closed portion of the <br />alley is adjacent to Parcels 1, 2, 4.1 <br />and a portion of Parcel 5 on City Real <br />Property Tax Map 31. <br />PROVIDED, HOWEVER, that the City of Charlottesville <br />hereby reserves unto itself a perpetual easement ten feet in <br />width on either side of the centerline of any water, gas, <br />sanitary or storm sewer mains presently located in the area <br />being vacated, including the perpetual right of ingress and <br />egress over the vacated area for the purpose of installing, <br />maintaining, repairing or replacing such utility lines or <br />mains. <br />BE IT FURTHER ORDAINED that the Clerk of the Council <br />shall send a copy of this ordinance with plat attached to the <br />Clerk of the Circuit Court for recordation in the current <br />street closing book. <br />Approved by Council <br />January 4, 1988 <br />1 rk of Council <br />87-7-38 <br />
