• (or the international "No Smoking" symbol consisting of a <br />pictorial representation of a burning cigarette enclosed in a red <br />circle with a red bar across it). Print on such signs shall be <br />at least one (1) inch in height and the international symbol <br />shall have a circle of at least four (4) inches in diameter. <br />• <br />(b) Every restaurant regulated by this ordinance shall post <br />at or near its entrance a sign stating that a non-smoking section <br />is available, and whether it is physically separated by a wall <br />from the smoking section (i.e., "partitioned" or "non -partitioned"). <br />(c) "No Smoking" signs may, but are not required to, <br />contain language that violation of the no smoking prohibition is <br />a class IV misdemeanor and punishable by a fine up to $100. <br />(d) Small restaurants, which by reason of their more <br />limited seating capacity are not otherwise subject to this chapter, <br />shall post signs at or near their entrances that adequately <br />inform the public of what type of non-smoking or smoking policy <br />is preferred and enforced by management within the restaurant. <br />Section 24-.1-10. Enforcement. <br />(a) The provisions of this chapter shall be enforced by the <br />Thomas Jefferson Health District, or any other department or <br />person duly designated by the City Manager. <br />(b) Any citizen who desires to register a complaint under <br />this chapter may initiate enforcement with the Thomas Jefferson <br />Health District. <br />Section 24.1-11. Penalty. <br />(a) Any person who violates any provision of this chapter, <br />whether he or she manages or otherwise controls an area regulated <br />by this ordinance or smokes in violation of the ordinance, shall <br />be deemed to be guilty of a Class IV misdemeanor. <br />(b) Each day of violation of any provision of this chapter <br />shall constitute a separate offense. <br />Section 24.1-12. Severability. <br />If any part, section, subsection, sentence, clause or phrase <br />of this chapter is for any reason declared to be unconstitutional <br />or invalid, such judicial decision shall not affect the validity <br />of the remaining portions of this chapter. , <br />2.
