• AN ORDINANCE <br />TO AMEND AND REORDAIN SECTION 28-4 OF THE CODE <br />OF THE CITY OF CHARLOTTESVILLE, 1976, AS AMENDED, <br />RELATING TO THE LOCATION OF CITY UTILITY LINES. <br />BE IT ORDAINED by the Council of the City of Charlottes- <br />ville, Virginia, that Section 28-4 of the Code of the City of <br />Charlottesville, 1976, as amended, .is hereby amended and <br />reordained as follows: <br />Sec. 28-4. City utility lines generally. <br />(a) Buildings in relation to sewer, water and gas <br />mains. Buildings shall not be constructed within ten feet of <br />any storm or sanitary sewer, water or gas main. For <br />purposes of this section. "main" shall include all structures <br />that are an integral part of the utility system. such as box <br />culverts and manholes. However, the director of public works <br />may grant written waivers of this restriction, with respect <br />to water. storm or sanitary aed sewer mains, upon a finding that <br />the plans for a proposed building provide adequate safety <br />measures to protect the main during and after construction and <br />adequate access for the city's maintenance, repair or replacement <br />of the main. When such a written waiver is granted. the director <br />of public works may also require that the private property owner <br />• enter into a recordable agreement promising to maintain that <br />portion of the utility main under the owner's building or within <br />the ten (10) foot setback. <br />(b) Changing of depth of cover over sewer, water or gas <br />mains.
