TREMBLAY ("Tremblay.") <br />W I T N E S S E T H: <br />That for good and valuable consideration, the City agrees <br />to sell to Tremblay and Tremblay agrees to buy from the City <br />the following described property: <br />All that certain lot or parcel of real property <br />designated as Tax Map 4, Parcel 277, at the <br />southeast corner of 13th. and John Streets in <br />the City of Charlottesville, as shown on the <br />attached "Plat Showing Physical Survey of <br />Property at 326 13th. Street" by Gary M. Whelan, <br />dated July 23, 1986, (the "Property") <br />upon the following terms and conditions: <br />1. Purchase Price: Tremblay shall pay Five Thousand <br />Five Hundred Eighty -Nine Dollars ($5,589.00) in cash at closing <br />for the Property. <br />2. Zoning: This contract is contingent upon the property <br />being rezoned from R-2 (Residential District) to R-3 (Multiple <br />Residential Dwelling District.) Tremblay shall apply to have <br />the Property rezoned and diligently pursue such application. <br />The City shall not be obligated to rezone the Property as a <br />result of this Contract but shall consider such application <br />in the same way as if the City did not own the Property. <br />3. Closing: Closing shall be within 15 days after <br />approval <br />of <br />Tremblay's application to <br />have <br />the Property <br />rezoned. <br />If <br />such application is denied, <br />this <br />Contract shall <br />be null and void. <br />
