• AN ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />A PORTION OF SUNSET AVENUE <br />WHEREAS, proper notice that the City of Charlottesville <br />would consider closing, vacating and discontinuing a portion <br />of Sunset Avenue, as hereinafter described, was duly posted <br />and advertised; and <br />WHEREAS, all owners abutting said street have been duly <br />notified; and <br />WHEREAS, pursuant to the statutes in such cases made and <br />provided, the Council held a joint public hearing with the <br />Planning Commission on April 12, 1988, and received comments <br />from City staff, the Planning Commission and the public; and <br />WHEREAS, for reasons set forth in a memorandum to City <br />Council by the Secretary of the Planning Commission dated <br />April 27, 1988, the Commission has recommended vacation and <br />closure of certain portions of Sunset Avenue; and <br />WHEREAS, this Council agrees with such reasons for <br />closure which related primarily to considerations of traffic <br />• engineering safety; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottes- <br />ville, Virginia that the portion of Sunset Avenue, more <br />particularly described as follows, is hereby closed, vacated <br />and discontinued as a public thoroughfare of the City of <br />Charlottesville, Virginia, said portion of the street not <br />being safe or needed for motor vehicle travel by City <br />residents and members of the public; <br />Ten (10) feet of Sunset Avenue immediately <br />east of Moore's Creek measured from the <br />eastern edge of the current bridge deck, as <br />shown in detail on the attached sketch which <br />is made a part hereof. <br />PROVIDED, HOWEVER, that the City of Charlottesville <br />hereby reserves unto itself and its assigns (including the <br />Rivanna Water and Sewer Authority), the following perpetual <br />easements within that portion of Sunset Avenue being vacated <br />by this ordinance: <br />1) An easement ten (10) feet in width on either <br />side of the centerline of any existing water, gas, sanitary <br />or storm sewer lines or mains along with right of ingress and <br />egress by the City or its assigns for the repair, <br />. maintenance or replacement of said utilities. <br />
