• AN ORDINANCE CLOSING, VACATING AND DISCONTINUING A PORTION OF SUNSET AVENUE WHEREAS, proper notice that the City of Charlottesville would consider closing, vacating and discontinuing a portion of Sunset Avenue, as hereinafter described, was duly posted and advertised; and WHEREAS, all owners abutting said street have been duly notified; and WHEREAS, pursuant to the statutes in such cases made and provided, the Council held a joint public hearing with the Planning Commission on April 12, 1988, and received comments from City staff, the Planning Commission and the public; and WHEREAS, for reasons set forth in a memorandum to City Council by the Secretary of the Planning Commission dated April 27, 1988, the Commission has recommended vacation and closure of certain portions of Sunset Avenue; and WHEREAS, this Council agrees with such reasons for closure which related primarily to considerations of traffic • engineering safety; now, therefore, BE IT ORDAINED by the Council of the City of Charlottes- ville, Virginia that the portion of Sunset Avenue, more particularly described as follows, is hereby closed, vacated and discontinued as a public thoroughfare of the City of Charlottesville, Virginia, said portion of the street not being safe or needed for motor vehicle travel by City residents and members of the public; Ten (10) feet of Sunset Avenue immediately east of Moore's Creek measured from the eastern edge of the current bridge deck, as shown in detail on the attached sketch which is made a part hereof. PROVIDED, HOWEVER, that the City of Charlottesville hereby reserves unto itself and its assigns (including the Rivanna Water and Sewer Authority), the following perpetual easements within that portion of Sunset Avenue being vacated by this ordinance: 1) An easement ten (10) feet in width on either side of the centerline of any existing water, gas, sanitary or storm sewer lines or mains along with right of ingress and egress by the City or its assigns for the repair, . maintenance or replacement of said utilities.
