• AN ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />A PORTION OF COLEMAN STREET <br />WHEREAS, proper notice that G. A. Land Trust would <br />request the City Planning Commission to initiate street <br />closing procedures to close a portion of Coleman Street was <br />duly posted and advertised; <br />WHEREAS, owners along the street proposed to be vacated <br />have been duly notified; and <br />WHEREAS, pursuant to the statutes in such cases made and <br />provided, the Council held a joint public hearing with the <br />Planning Commission on April 12, 1988, and received comments <br />from the City staff, the Planning Commission and the public; <br />and <br />WHEREAS, the Planning Commission has recommended closure <br />of that portion of Coleman Street; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottes- <br />ville, Virginia that the said portion of the street located <br />• in said City, described as follows, is hereby closed, vacated <br />and discontinued as a public thoroughfare of the City of <br />Charlottesville, Virginia, said portion of the street not <br />being needed for public use and travel: <br />That portion of Coleman Street from its <br />intersection with Smith Street to a point 360 <br />feet south, and adjacent to Parcels 113, <br />113.1, 113.2, 122.1, 123, and 124 on City Tax <br />Map 49. <br />PROVIDED, HOWEVER, that the City of Charlottesville <br />hereby reserves unto itself a perpetual easement ten feet in <br />width on either side of the centerline of any water, gas, <br />sanitary or storm sewer mains presently located in the area <br />being vacated, including the perpetual right of ingress and <br />egress over the vacated area for the purpose of installing, <br />maintaining, repairing or replacing such utility lines or <br />mains. <br />BE IT FURTHER ORDAINED that the Clerk of the Council <br />shall send a copy of this ordinance with plat attached to the <br />Clerk of the Circuit Court for recordation in the current <br />street closing book. <br />Approved by Council <br />May 16, 1988 <br />UA • <br />erk of Council <br />
