entdeer-este-sPiei3--be-��ri�tec}-�a-eeeh-�3eek-o£-�ie-�na-)->-r--Phe <br />part iena-et-ttte-iw13 having-partia+-f-rerrtage-eir—.udSheet;-N-E- <br />and-en-Presterr-Aveae ra>-)--be- -ee►±sa-dereepe-L-t9rleeks-ter-this <br />pnrpese- <br />(e) operation of any such cafe shall comply with all <br />provisions of state health laws and regulations regarding the <br />service and preparation of food and, where applicable, the <br />regulations of the state alcoholic beverage control board. <br />(f) Within the designated area of a cafe, the operator holding <br />a permit under this section shall have the right to limit access <br />and occupancy only to bona fide paying customers of his or her <br />restaurant, who are behaving in a lawful manner, and shall have the <br />same right to deny admission or service as he or she exercises on <br />his or her own premises. However, no person shall be denied access <br />or service to the cafe area on the basis or race, religion, <br />national origin, sex or physical handicap. <br />(g) As a condition of such permit, the cafe operator shall <br />indemnify the city and hold it harmless from all claims for damages <br />or injuries of any kind whatsoever arising out of or caused by the <br />location or operation of the cafe on the public right-of-way of the <br />city. The operator shall keep in force and furnish the city with <br />evidence of public liability insurance coverage in the amount of at <br />least three hundred thousand dollars single limit coverage during <br />all periods in which such cafe is in operation. <br />(h) City council may revoke any permit granted hereunder, <br />after a hearing conducted at any regular meeting of the council, <br />provided the cafe operator has been notified of such hearing by <br />written notice delivered to his or her place of business at least <br />five days before such meeting if the council finds that the <br />operator is violating any of the terms of his or her permit or that <br />the cafe poses a threat to the public health, safety and welfare or <br />constitutes a public nuisance. <br />(i) The city zoning administrator shall be responsible for <br />receiving applications for cafe permits and forwarding them to city <br />council, and for monitoring compliance with the requirements of <br />this section. <br />Approved by Council <br />November 19, 1990 <br />erk of City Council <br />90-7-36 <br />40 <br />
