• AN ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />A PORTION OF CHESTNUT STREET. <br />WHEREAS, proper notice that Aliant Development, Inc. would <br />request the City Planning Commission to initiate street closing <br />procedures to close an undeveloped portion of Chestnut Street from <br />Cherry Street to the CSX railroad right-of-way, was duly posted and <br />advertised; <br />WHEREAS, owners along the street proposed to be vacated have <br />been duly notified; <br />WHEREAS, a joint public hearing by the Planning Commission and <br />City Council was held on August 14, 1990, and comments from the <br />City staff, the Planning Commission and the public were made and <br />heard; and <br />WHEREAS, the Planning Commission recommended closure of said <br />portion of Chestnut Street; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia that the above -referenced portion of Chestnut Street, <br />• described as follows, is hereby closed, vacated and discontinued as <br />a public thoroughfare of the City of Charlottesville, Virginia, <br />said street not being needed for public use and travel: <br />That portion of Chestnut Street, designated as <br />Parcel X and Parcel Y on the attached plat <br />made by Thomas B. Lincoln Land Surveyor, Inc. <br />dated August 24, 1990, approximately 50 feet <br />wide and a distance of approximately 100 feet, <br />beginning at its intersection with Cherry <br />Street and ending approximately 35 feet south <br />of its terminus at the CSX railroad right-of- <br />way, adjoining Parcel 145 on City Tax Map 57. <br />BE IT FURTHER ORDAINED that the Clerk of the Council shall <br />send a copy of this ordinance with plat attached to the Clerk of <br />the Circuit Court for recordation in the current street closing <br />book. <br />Approved by Council <br />August 20, 1990 <br />rk of City Coun it <br />7-31 <br />0 <br />
