• also furnish the usual closing papers, including a certificate evidencing the fact that no litigation is pending or threatened in any way affecting the validity of the Bonds or the right and duty of the City to levy ad valorem taxes, without limitation of rate or amount, for the payment of the Bonds and the interest thereon. The successful bidder shall deliver written instructions to the Registrar at its principal corporate trust office not less than five (5) business days prior to the scheduled delivery of the bonds as to the manner in which the Bonds shall be registered at delivery, including the name and address of each registered owner, the principal amount of each maturity to be registered to such registered owner, and, if a single registered owner shall require more than one Bond of any maturity, the number and principal amount of Bonds of such maturity to be registered to such registered owner. In the absence of instructions, the Bonds will be registered in the name of the successful bidder in such denomination or denominations as the Registrar shall determine. It is anticipated that CUSIP identification numbers will be imprinted on the Bonds, but neither the failure e to print any such number on any Bond nor any inaccuracy, error or omission with respect thereto shall constitute cause for failure or refusal by the successful bidder for the Bonds to accept • delivery of and pay for the Bonds in accordance with the terms of its bid. No such CUSIP identification number shall constitute a part of the contract evidenced by the particular Bond upon which it is printed, and no liability shall attach to the City or any officer or agent thereof, including any paying agent for the Bonds, by reason of such numbers or any use made thereof, including any use thereof made by the City, any such officer or any such agent, or by reason of any inaccuracy, error or omission with respect thereto or in such use. All expenses in relation to the printing of such numbers on the Bonds will be paid by the City; provided, however, that the CUSIP Service Bureau charge for the assignment of such numbers shall be the responsibility of and shall be paid by the purchaser. No additional general obligation bonds of the City will be offered for sale prior to , without the consent of the purchasers of the Bonds.
