0 <br />• <br />sum of five hundred dollars ($500.00) for each linear mile, or <br />fraction thereof, of overhead or underground cable in place. <br />Such payments shall be in addition to, and not in lieu of, any <br />business license tax, real or personal property tax, or other <br />tax of general application to which the Company may be subject. <br />Section 10. The term of this agreement shall be for a period <br />of five (5) years from the effective date of this agreement. If <br />the Company wishes to maintain its equipment within the City <br />and to continue the operation of the system, it shall give <br />written notice to the City at least ninety (90) days before <br />expiration of the agreement, stating that it wishes to apply <br />for a new agreement. Such application shall include a <br />comprehensive report of the status of the Company's system <br />within the City, any plans for alteration, expansion or <br />improvement of the system, and a statement as to whether the <br />Company has complied with the provisions of this ordinance. <br />The City may grant the Company a new agreement if it determines <br />that there has been substantial compliance with the material <br />provisions of this ordinance, and there is no other good cause <br />why the Company should not be granted a new agreement. Any new <br />agreement shall be granted upon such terms and conditions as <br />the City Council of the City of Charlottesville deems <br />reasonable and appropriate. If a new agreement is not granted <br />to the Company, the City may require the Company to remove all <br />lines, cables and equipment from all City streets and <br />rights-of-way at the company's own expense within six <br />(6)months after the expiration of this ordinance. <br />Section 11. Nothing in this agreement shall be construed to <br />mean that this is an exclusive agreement, as the City Council <br />reserves the right to grant additional telephone agreements to <br />other parties. <br />Section 12. All ordinances and parts of ordinances in conflict <br />herewith are repealed. <br />Section 13.
