• AN ORDINANCE <br />TO AMEND SECTION 19-95.1 TO CHAPTER 19 <br />OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, <br />RELATED TO EARLY RETIREMENT OPTIONS. <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia, that section 19-95.1 of the Code of the City of <br />Charlottesville, 1990, as amended, is hereby amended to read as <br />follows: <br />Section 19-95.1. Same - Special early retirement window. <br />(a) Any member who is in service and who falls within any one <br />of the following eligibility categories at any time between June 1, <br />1991 and June 30, 1992, may elect to retire early under this <br />section upon written notification to the commission; provided that <br />said election is made no later than September 30, 1991: <br />(1) Any member who is at least age 52 with 30 years or <br />more of creditable service; or <br />(2) Any member who is at least age 55 with 27 years or <br />more of creditable service; or <br />• (3) Any member who is at least age 57 with 5 years or <br />more of creditable service; or <br />(4) Any police officer, firefighter, sheriff or <br />sheriff's deputy who is at least age 52 with 5 years or more of <br />creditable service; or <br />(5) Any member who is eligible for normal or early <br />retirement under the provisions of subsection (a), (e) or (g) of <br />section 19-95. <br />(b) For any member who elects to retire under this section <br />and who does not already meet the early retirement provisions of <br />either subsection (e) or (g) of section 19-95, three additional <br />years will be added to the member's age or creditable service, <br />whichever is applicable, to enable the member to meet or exceed <br />said early retirement provisions. For any member who already meets <br />the normal or early retirement provisions of subsection (a), (e) or <br />(g) of section 19-95, three additional years will be added to the <br />member's creditable service. <br />(c) The annual retirement allowance payable monthly to any <br />member who elects to retire under this section shall be calculated <br />pursuant the provisions of subsection (a), (b) or (c) of section <br />19-96. In addition, any member under age 62 who elects to retire <br />under this section shall be paid a monthly supplement until age 62, <br />• calculated at 35% of the member's age 65 estimated social security <br />benefit. In lieu of said supplement, a police officer, <br />firefighter, sheriff or sheriff's deputy shall receive the <br />
