Grantee shall strictly adhere to all building and znniny codes currently or hereafter applicable to construction, • operation or maintenance of the System in the City. B. The City shall have the right to inspect all construction or Installation work performed pursuant to the provisions of this Franchise and to make such tests as it shall find necessary to ensure compliance with the terms of the Franchise and applicable provisions of local, state and federal law. C. Nothing contained in this Franchise shall be construed to give or to withhold from Grantee t- tie authority to enter upon or work on private property in areas not encumbered with public easements without rhe permission of the property owner. 7.05 Ren�_ir of Strut_ and Pr_9pertX. Any and all Streets or Public Property or private property, which are disturbed -r damaged during the construction, repair, replacement, relocation, operation, maintenance or reconstruction of the System shall be promptly repaired by Grantee, at its expense, to a condition as good as that prevailing prior to Grantee's construction. 7.06 Use of Exi_ssigg_1 oleg. Grantee shall not erect, for any reason, any pole on or along any Street in an existing aerial utility System without the advance written approval -f • the City. Grantee shall exercise its best efforts to negotiar- the lease of pole space and facilities from the existing pol- owners for all aerial construction. • 7.07 Underorot ding of Cable. Cable shall be installed underground at Grantee's expense where both the existin•1 telephone and electrical utilities are already underground. Grantee shall place cable underground in newly platted areas ill concert with both the telephone and electrical utilities. li the event that telephone or electric utilities are reimbursed by the City or any agency thereof for the placement of cable underground or the movement of cable, Grantee shall be reimbursed upon the same terms and conditions as the telephone or electric utilities. A. Nothing in this Franchise shall be construed t:, prevent the City from constructing, maintaining, repairiil(I or relocating sewers; grading, pavino, maintaininn, repairing, relocating and/or altering any Street; constructing, laying down, repairing, maintaining nr relocating any water mains; or constructing, maintaininu. relocating, or repairing any sidewalk or other public work. -19-
