• AN ORDINANCE TO AMEND AND REORDAIN SECTIONS 26-28, 26-37, 26-61, 26-64, AND 26-65 OF CHAPTER 26 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, RELATED TO SOLID WASTE COLLECTION. BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that Sections 26-28, 26-37, 26-61, 26-64 and 26-65 of Chapter 26 (Solid Waste) of the Code of the City of Charlottesville, 1990, as amended, are hereby amended and reordained as follows: CHAPTER 26 - SOLID WASTE ARTICLE II. COLLECTION BY CITY Section 26-27. General container requirements. All ashes, glass, kitchen garbage consisting in whole or in part of foodstuff, tin cans and other damp garbage shall be drained and placed in a closed nonleaking container of not over thirty-two (32) gallons capacity. Paper or cardboard containers are not approved for use under this chapter. • Section 26-28. Paper, cartons, etc., to be placed in containers or bundled. (a) Dry trash, such as paper, old cartons, weeds, brush or brush trimmings not exceeding three feet in length may be placed in the container required by section 26-27 or may be placed in baskets or boxes, if the material is secured so as to prevent the trash from being blown therefrom. This article is adopted pursuant to Virginia Code §15.1-11.5:3, §15.1-879 and §15.1-857 in order to better protect the health, safety and welfare of the public and the environment by establishing a fee for the city service of disposing of refuse generated by commercial property owners located within city boundaries. Section 26-36. Definitions. . The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: 1
