• AN ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />A PORTION OF FLORENCE ROAD <br />WHEREAS, proper notice that Rives Land Trust would request the <br />City Planning Commission to initiate street closing procedures to <br />close a portion of Florence Road; and <br />WHEREAS, owners adjacent to the street proposed to be vacated <br />have been duly notified; <br />WHEREAS, a joint public hearing by the Planning Commission and <br />City Council was held on June 9, 1992, and comments from the City <br />staff, the Planning Commission and the public were made and heard; <br />and <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia that the above -referenced street right-of-way, described <br />as follows, is hereby closed, vacated and discontinued as a public <br />thoroughfare of the City of Charlottesville, Virginia, said street <br />not being needed for public use and travel: <br />That portion of Florence Road, approximately <br />46 feet wide and running a distance of <br />• approximately 84 feet from the western end of <br />Florence Road to the northeast corner of <br />property designated as Parcel 9 on City Real <br />Estate Tax Map 61. <br />• <br />PROVIDED HOWEVER, that this closing is conditioned upon a <br />reservation by the City of easement(s) for utility lines located or <br />to be located in the area being vacated and necessary to serve the <br />proposed project known as "Ridgecrest", including the perpetual <br />right of ingress and egress over the vacated area for the purpose <br />of installing, maintaining, repairing or replacing such utility <br />lines. <br />BE IT FURTHER ORDAINED that the Clerk of the Council shall <br />send a copy of this ordinance with plat attached to the Clerk of <br />the Circuit Court for recordation in the current street closing <br />book. <br />Approved by Council <br />August 3, 1992 <br />C rk of City Council <br />92-7-34 <br />
