• AN ORDINANCE <br />AMENDING AND REORDAINING SECTIONS 29-38 AND 29-87 OF THE CODE <br />OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, <br />RELATED TO INSTALLATION COSTS OF <br />WATER AND SEWER LINE EXTENSIONS IN SUBDIVISIONS. <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia that Sections 29-38 and 29-87 of Article II of Chapter 29 <br />of the Code of the City of Charlottesville, 1990, as amended, is <br />hereby amended and reordained as follows: <br />CHAPTER 29. SUBDIVISIONS <br />ARTICLE II. DESIGN STANDARDS AND IMPROVEMENTS. <br />Section 29-38. City not obligated to pay for improvements. <br />Nothing in this chapter shall be construed as creating an <br />obligation upon the city to pay for grading or paving of streets, <br />or for sidewalks, sewers or drainage facilities, curb and gutter <br />improvements, utility lines or construction of any other <br />facilities, except for the obligation to pay one-half the estimated <br />cost of water and sewer lines in certain subdivisions approved <br />. prior to March 4 1991, as set forth in Section 29-87. <br />Section 29-87. Cost of improvements. <br />(a) All public and private improvements, amenities and <br />features required to be installed within a subdivision under this <br />chapter shall be made at the applicant's or developer's sole cost <br />and expense, and at no cost to the city, with the following <br />exceptions: <br />(1) The city shall bear one-half the cost estimated by the <br />director of public works of installing extensions of city <br />water and sewer mains in anv suhdivicinn r; <br />begun before March 4 1993 <br />a. Where the developer has contracted with the city <br />for such installation he shall advance to the city <br />the total amount, in cash, of such estimated cost <br />at the time of signing such contract. Upon <br />completion of such installation and acceptance of <br />streets in the subdivision for city maintenance, if <br />• a developer is entitled to a refund of.a portion of <br />the costs. the developer may apply to the director <br />of public works for a such refund ef-t9*te­-<_-i-t-pLs <br />
