4 <br />• <br />Prepared June 15, 1992 <br />AN ORDINANCE <br />AMENDING AND REORDAINING SECTION 17-30 OF CHAPTER 17, AND <br />SECTIONS 26-27, 26-30, 26-31, 26-40, 26-41, 26-61, <br />26-66, 26-68, 26-70 OF CHAPTER 26, AND ADDING NEW <br />SECTIONS NUMBER 26-71 AND 26-72 TO CHAPTER 26, OF THE CODE <br />OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, <br />RELATING TO THE COLLECTION OF SOLID WASTE. <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia that Section 17-30 of Chapter 17, and Sections 26-27, 26- <br />30, 26-31, 26-40, 26-41, 26-61, 26-66, 26-68, 26-70 of Chapter 26, <br />are hereby amended and reordained, and two new sections number 26- <br />71 and 26-72 are hereby added to Chapter 26, of the Code of the <br />City of Charlottesville, 1990, as amended, to read as follows: <br />OFFENSES - MISCELLANEOUS <br />Sec. 17-30. Unlawful accumulations of garbage, refuse, etc. <br />. (a) It shall be unlawful and a Class 1 misdemeanor for any <br />person to allow to accumulate on private premises any of the <br />following: Refuse, garbage, rubbish, paper, trash, manure, offal, <br />ashes, vegetable matter, broken glass, stagnant water or any other <br />matter or substance calculated to render the premises unclean or <br />unsafe to any person or that is liable to injuriously affect <br />publish health or safety. <br />(b) Whenever the city manager determines that any condition <br />exists in violation of this section, the manager shall notify the <br />property owner of record of such determination by first class mail, <br />sent to the address listed in the real estate tax records, <br />requiring such property owner to correct the condition. An <br />affidavit shall be prepared evidencing such mailing. If the <br />condition is not corrected w}th}n-ten-{4A+-days after the mailing <br />of eaeh reasonable notice, the city manager may order such <br />condition to be removed or corrected, either by city forces or by <br />a private contractor. The cost thereof, together with an <br />administrative handling charge of fifteen dollars ($15.00), shall <br />be billed to the property owner and if not paid shall be added to <br />and collected in the same manner as the real estate tax on such <br />property where the violation occurred. <br />
