ARTICLE V. FEES FOR CURBSIDE REFUSE COLLECTION AND DISPOSAL. <br />• Section 26-60. Purpose. <br />This Council finds that reduction of the solid waste stream <br />through imposition of volume based user fees is one effective means <br />of addressing the growing problem and escalating costs of solid <br />waste disposal. Such fees should also encourage recycling and help <br />our locality meet the state mandate of reducing our locality's <br />waste stream by 25%. For these reasons, the Council finds that the <br />public interest will be better served if the following provisions <br />are enacted: <br />Section 26-61. Definitions. <br />Curbside Customers - are those persons who either reside or <br />operate businesses within the city and the properties on which they <br />reside or operate a business meet the following two criteria: (1) <br />such properties receive once a week curbside refuse collection <br />service from the City, and (2) such properties on the average <br />generate refuse each week which would fill less than twelve (12) <br />thirty-two gallon containers. Excluded from this definition under <br />this article are those persons who own or operate "commercial <br />properties" as defined in Article III of this chapter - meaning <br />properties which use dumpsters. Additional persons may be <br />designated "curbside customers" if the properties on which they <br />• reside or operate a business justify a finding by the Director of <br />Public Works that the location of the subject property makes it <br />impractical to serve with front loading City refuse trucks. <br />Refuse - means garbage, trash, debris, litter and other solid <br />waste which the City regularly collects as part of its curbside <br />collection and which is more fully defined in §26-36 of this <br />Chapter. This does not include hazardous waste, white goods, <br />furniture, tires, automobile parts, asbestos and inert waste such <br />as dirt, logs, rock, construction materials, brush (unless tied in <br />bundles less than 3 feet long) or demolition debris. <br />Disposal Stickers or Stickers - are paper stickers purchased <br />from the City or its authorized agents. They shall be a distinctive <br />color and shall be printed with the City Seal or appropriate words <br />which will readily indicate to City collectors of curbside refuse <br />that the bags or containers on which the stickers are attached are <br />intended for city refuse collection. They may be of two types, one <br />for large size containers of no more than 32 gallons weighing no <br />more than 50 pounds or small containers of no more than 16 gallon <br />capacity weighing no more than 25 pounds. <br />Section 26-62. Scope of Service. <br />City-wide curbside collection and refuse disposal service <br />shall be provided only to curbside customers of the City who comply <br />• with this Article and other applicable code provisions. <br />D <br />
