SECTION 7. CONSTRUCTION PROVISIONS. <br />• 7.01 Construction Timetable. <br />A. Grantee shall give notice to the City sixty (50) <br />days prior to the anticipated completion date of the <br />System Upgrade. <br />B. Upon completion of the System Upgrade, Grantee <br />shall provide City with a written certification that <br />construction has been completed pursuant to all applicable <br />Franchise provisions and state and federal law. <br />C. Upon receipt of the certification identified in <br />paragraph (B) above, the City shall have forty-five (45) <br />days to obtain a written report from an independent <br />engineer confirming the completion of construction; <br />provided, however, that if the City fails to obtain such a <br />written report within said forty-five (45) days, the <br />construction shall be deemed completed, unless the failure <br />to obtain such a report is due to unforeseen events, acts <br />of God, or events beyond the reasonable control of the <br />City. <br />D. Notwithstanding anything contained herein to the <br />contrary, the City may condition completion of <br />construction of the System Upgrade upon receipt of a <br />written report from an independent engineer, which report- <br />confirms <br />eportconfirms the following: <br />1. That all construction has been completed or <br />is otherwise satisfactorily resolved; <br />2. Satisfactory test results using the <br />technical standards set forth in Section 5.05 and <br />using the following tests: <br />a. Signal level <br />b. Hum <br />C. Band pass response of system <br />d. Carrier to noise <br />3. Compliance with all applicable state and <br />federal law, codes, and standards; and <br />4. Installation and the proper working ^L the <br />Emergency Alert System required at Section 5.04 <br />hereof. <br />E. If the independent engineer's report establishes <br />• that the System has been constructed in accordance witli <br />this Franchise and state and federal law, the City shall <br />bear the expense of the independent engineer. <br />-17- <br />
