• AN ORDINANCE CLOSING, VACATING AND ABANDONING LYMAN STREET WHEREAS, proper notice that the Charlottesville Industrial Development Authority would request the City Planning Commission to initiate street closing procedures to close the Lyman Street right- of-way, varying from 40 to 70 feet in width, and running a distance of approximately 1,030 feet from the Belmont Bridge to Douglas Avenue; and WHEREAS, owners along the street proposed to be vacated have been duly notified; WHEREAS, a joint public hearing by the Planning Commission and City Council was held on May 11, 1993, and comments from the City staff, the Planning Commission and the public were made and heard; and WHEREAS, the Planning Commission recommended closure of the Lyman Street right-of-way; now, therefore, BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the Lyman Street right-of-way, described as follows, is hereby closed, vacated and abandoned as a public thoroughfare of the City of Charlottesville, Virginia, said street not being needed • for public use and travel: The Lyman Street right-of-way running parallel to the CSX tracks, containing approximately 33,361.74 square feet, from the western edge of the Belmont Bridge to Douglas Avenue, labeled as "Lyman Street To Be Closed" on the attached plat dated September 29, 1993, and made by Thomas B. Lincoln Land Surveyor, Inc. PROVIDED, HOWEVER, that the City of Charlottesville hereby reserves unto itself (1) a perpetual easement ten feet in width on either side of the center line of any water, gas, sanitary or storm sewer mains presently located in the area being vacated, including the perpetual right of ingress and egress over the vacated area for the purpose of installing, maintaining, repairing or replacing such utility lines or mains, and (2) a perpetual easement of support for and to the airspace now occupied by the Belmont Bridge, together with the right to repair, replace, construct, and maintain said Bridge. BE IT FURTHER ORDAINED that the Clerk of the Council shall not send a copy of this ordinance with plat attached to the Clerk of the Circuit Court for recordation in the current street closing book until the following conditions have been met, as certified to the Clerk of Council by the City Attorney:
