• AN ORDINANCE <br />CLOSING, VACATING AND ABANDONING <br />LYMAN STREET <br />WHEREAS, proper notice that the Charlottesville Industrial <br />Development Authority would request the City Planning Commission to <br />initiate street closing procedures to close the Lyman Street right- <br />of-way, varying from 40 to 70 feet in width, and running a distance <br />of approximately 1,030 feet from the Belmont Bridge to Douglas <br />Avenue; and <br />WHEREAS, owners along the street proposed to be vacated have <br />been duly notified; <br />WHEREAS, a joint public hearing by the Planning Commission and <br />City Council was held on May 11, 1993, and comments from the City <br />staff, the Planning Commission and the public were made and heard; <br />and <br />WHEREAS, the Planning Commission recommended closure of the <br />Lyman Street right-of-way; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia that the Lyman Street right-of-way, described as follows, <br />is hereby closed, vacated and abandoned as a public thoroughfare of <br />the City of Charlottesville, Virginia, said street not being needed <br />• for public use and travel: <br />The Lyman Street right-of-way running parallel <br />to the CSX tracks, containing approximately <br />33,361.74 square feet, from the western edge <br />of the Belmont Bridge to Douglas Avenue, <br />labeled as "Lyman Street To Be Closed" on the <br />attached plat dated September 29, 1993, and <br />made by Thomas B. Lincoln Land Surveyor, Inc. <br />PROVIDED, HOWEVER, that the City of Charlottesville hereby <br />reserves unto itself (1) a perpetual easement ten feet in width on <br />either side of the center line of any water, gas, sanitary or storm <br />sewer mains presently located in the area being vacated, including <br />the perpetual right of ingress and egress over the vacated area for <br />the purpose of installing, maintaining, repairing or replacing such <br />utility lines or mains, and (2) a perpetual easement of support for <br />and to the airspace now occupied by the Belmont Bridge, together <br />with the right to repair, replace, construct, and maintain said <br />Bridge. <br />BE IT FURTHER ORDAINED that the Clerk of the Council shall not <br />send a copy of this ordinance with plat attached to the Clerk of <br />the Circuit Court for recordation in the current street closing <br />book until the following conditions have been met, as certified to <br />the Clerk of Council by the City Attorney: <br />
