• <br />Section 10. The term of this agreement shall be for a period of five (5) years <br />from the effective date of this agreement. If the Company wishes to maintain its equipment <br />within the City and to continue the operation of the system, it shall give written notice to the <br />City at least ninety (90) days before expiration of the agreement, stating that it wishes to apply <br />for a new agreement. Such application shall include a comprehensive report of the status of the <br />Company's system within the City, any plans for alteration, expansion, or improvement of the <br />system, and a statement as to whether the Company has complied with the provisions of this <br />ordinance. The City may grant the Company a new agreement if it determines that there has <br />been substantial compliance with the material provisions of this ordinance, and there is no other <br />good cause why the Company should not be granted a new agreement. Any new agreement shall <br />be granted upon such terms and conditions as the City Council of the City of Charlottesville <br />deems reasonable and appropriate. If a new agreement is not granted to the Company, the City <br />may require the Company to remove all lines, cables, and equipment from all City streets and <br />rights -of -way at the Company's own expense within six (6) months after the expiration of this <br />ordinance. <br />Section 11. Nothing in this agreement shall be construed to mean that this is an <br />exclusive agreement, as the City Council reserves the right to grant additional communications <br />agreements to other parties. <br />repealed. <br />Section 12.
