AN ORDINANCE <br />•' CLOSING, VACATING AND DISCONTINUING <br />A PORTION OF HOLLY DRIVE <br />WHEREAS, proper notice that the Charlottesville Redevelopment <br />and Housing Authority would request the City Planning Commission to <br />initiate street closing procedures to close Holly Drive was duly <br />posted and advertised; <br />WHEREAS, a joint public hearing by the Planning Commission and <br />City Council was held on May 11, 1993, and comments from the City <br />staff, the Planning Commission and the public were made and heard; <br />and <br />WHEREAS, the Planning Commission recommended closure of Holly <br />Drive in 1993, but the matter was not considered by City Council at <br />that time due to a failure among the adjoining property owners and <br />the CRHA to agree on maintenance responsibilities; and <br />WHEREAS, the request has been modified to close only a portion <br />of Holly Drive, and the adjoining property owners support the <br />request; and <br />WHEREAS, owners along that portion of Holly Drive proposed to <br />be vacated, as well as the residents of Westhaven-, have been duly <br />• notified of the proposed closure; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia that the above -referenced portion of Holly Drive, <br />described as follows, is hereby closed, vacated and discontinued as <br />a public thoroughfare of the City of Charlottesville, Virginia, <br />said street not being needed for public use and travel: <br />That portion of Holly Drive, approximately 25 <br />feet in width, from the northern property line <br />of Parcel 156 on City Tax Map 31, running <br />approximately 191 feet in a southerly <br />direction to the terminus of Holly Drive. <br />PROVIDED, HOWEVER, that the City of Charlottesville hereby <br />reserves unto itself a perpetual easement ten feet in width on <br />either side of the center line of any water, gas, sanitary or storm <br />sewer mains presently located in the area being vacated, including <br />the perpetual right of ingress and egress over the vacated area for <br />the purpose of installing, maintaining, repairing or replacing such <br />utility lines or mains. <br />BE IT FURTHER ORDAINED that the Clerk of the Council shall <br />send a copy of this ordinance with plat attached to the Clerk of <br />the Circuit Court for recordation in the current street closing <br />book. <br />40 <br />Approved by Council <br />December 18, 1995 rk of City Counc 1 <br />
