retail customers is a peddler. Any person who does not keep a <br />regular place of business, with regular business hours, but at some <br />• vacant lot or other place offers to sell goods, wares and <br />merchandise to retail customers, is a peddler. Any person who <br />keeps a regular place of business, with regular business hours at <br />the same place, who other than at that regular place of business, <br />personally or through agents offers for sale or sells and, at the <br />time of such offering for sale, delivers goods, wares and <br />merchandise to retail customers, is a peddler. <br />Every peddler operating in the city shall obtain and maintain <br />a current city business license and shall pay an annual <br />license tax of fifty dellars ($S9.99) one hundred twenty five <br />dollars ($125.00). <br />Every vehicle used in peddling shall have conspicuously <br />displayed thereon the name of the peddler, together with the <br />street and number, city and state of his residence. <br />Any person selling or offering to sell as a peddler shall <br />exhibit his license on demand of any citizen of this city; and <br />upon his failure or refusal to do so, he shall be subject to <br />the penalties for doing business without a license. <br />The word "peddler" or peddlers," as used in this section, <br />shall be construed as including their bona fide employees. <br />• This subsection shall not apply to wholesale merchants <br />regularly licensed by the city and who shall at the same time <br />sell and deliver merchandise to retail merchants. <br />(e) Same - Exemptions. <br />(1) Notwithstanding the foregoing, no city license shall be <br />required of peddlers of wood, meat, milk, butter, eggs, <br />poultry, fish, oysters, game, vegetables, fruit or other <br />family supplies of a perishable nature grown or produced <br />by them and not purchased by them for sale. <br />(2) All peddlers of family supplies of a perishable nature <br />grown or produced by them and not purchased for sale <br />shall annually file with the commissioner of revenue a <br />certificate in duplicate under oath in which shall be <br />given the name and post office address of the applicant, <br />the location of the land on which the family supplies of <br />a perishable nature are produced or are to be produced, <br />whether the applicant is the owner thereof or renter, and <br />in the latter case, the name of the landlord or owner and <br />the time from which and to which the lease is to run. <br />(3) Upon receipt of such certificate and such other evidence <br />under oath as may be sufficient to establish the fact <br />that the applicant is entitled to the certificate, the <br />• commissioner of revenue shall endorse on one (1) copy of <br />such certificate the fact and date of its filing and <br />-2- <br />
