whatsoever arising from Grantee's exercise of rights or privileges stated herein. <br />2. In the event Grantor shall hereafter require, for its purposes, that Grantee alter, change, <br />adjust or relocate the above-mentioned improvements, across or under such street or highway, <br />the cost of such alteration, change, adjustment, or relocation will be the responsibility of the <br />Grantee. <br />3. This conveyance is made expressly subject to the restrictions, conditions, rights-of- <br />way and easements, if any, contained in duly recorded deeds, plats and other instruments <br />constituting the chain of title to the property conveyed herein, insofar as same affect said <br />property, which have not expired by a time limitation contained therein or otherwise have <br />become ineffective. <br />• 4 The County of Albemarle, acting by and through its County Executive, duly authorized <br />by resolution of the Board of supervisors of Albemarle County, does hereby convey the interest <br />in real estate made by this deed. <br />5. The City of Charlottesville, acting by and through its City Manager or his designee, <br />duly authorized by resolution of the City Council of the City of Charlottesville, does hereby <br />accept the conveyance of this easement, pursuant to Virginia Code § 15.2-1803, as evidenced by <br />the City's recordation of this deed. <br />This deed is exempt from recordation taxes imposed by Virginia Code §58.1-801 and <br />Virginia Code §58.1-802, pursuant to Virginia Code §58.1-811(A)(3) and Virginia Code §58.1- <br />811(C)(3), respectively. <br />Page 2 <br />
