0 AN ORDINANCE CLOSING, VACATING AND DISCONTINUING A PORTION OF SOUTH CHERRY STREET WHEREAS, proper notice was duly posted and advertised that Robert Snow would request the City Planning Commission to initiate street closing procedures to close a portion of South Cherry Street, approximately 30 feet in width and running a distance of approximately 252 feet, beginning east of its intersection with Garden Street and ending at the terminus of South Chevy Street, shown on the attached map drawn by the City Community Development Department; WHEREAS, owners along the alley proposed to be vacated have been duly notified; WHEREAS, joint public hearings by the Planning Commission and City Council were held on February 9, 1999 and April 14, 1999, and comments from the City staff, the Planning Commission and the public were made and heard; and WHEREAS, the Planning Commission recommended closure of the subject portion of South •Cherry Street; now, therefore, BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the subject public right-of-way, described as follows, is hereby closed, vacated and discontinued as a public thoroughfare of the City of Charlottesville, Virginia, said right-of-way not being needed for public use and travel: That portion of South Cherry Street, approximately 30 feet in width and running a distance of approximately 252 feet, beginning east of its intersection with Garden Street and ending at the terminus of South Cherry Street, shown on the attached map drawn by the City Community Development Department, and located on City Real Estate Tax Map 57 adjacent to Parcels 2 and 7.6. BE IT FURTHER ORDAINED that the Clerk of the Council shall send a copy of this ordinance with plat attached to the Clerk of the Circuit Court for recordation in the current street closing book.
