0 <br />AN ORDINANCE <br />CLOSING, VACATING AND DISCONTINUING <br />A PORTION OF SOUTH CHERRY STREET <br />WHEREAS, proper notice was duly posted and advertised that Robert Snow would request <br />the City Planning Commission to initiate street closing procedures to close a portion of South Cherry <br />Street, approximately 30 feet in width and running a distance of approximately 252 feet, beginning <br />east of its intersection with Garden Street and ending at the terminus of South Chevy Street, shown <br />on the attached map drawn by the City Community Development Department; <br />WHEREAS, owners along the alley proposed to be vacated have been duly notified; <br />WHEREAS, joint public hearings by the Planning Commission and City Council were held <br />on February 9, 1999 and April 14, 1999, and comments from the City staff, the Planning <br />Commission and the public were made and heard; and <br />WHEREAS, the Planning Commission recommended closure of the subject portion of South <br />•Cherry Street; now, therefore, <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the subject <br />public right-of-way, described as follows, is hereby closed, vacated and discontinued as a public <br />thoroughfare of the City of Charlottesville, Virginia, said right-of-way not being needed for public <br />use and travel: <br />That portion of South Cherry Street, approximately 30 feet in width <br />and running a distance of approximately 252 feet, beginning east of <br />its intersection with Garden Street and ending at the terminus of <br />South Cherry Street, shown on the attached map drawn by the City <br />Community Development Department, and located on City Real <br />Estate Tax Map 57 adjacent to Parcels 2 and 7.6. <br />BE IT FURTHER ORDAINED that the Clerk of the Council shall send a copy of this <br />ordinance with plat attached to the Clerk of the Circuit Court for recordation in the current street <br />closing book. <br />Approved by Council <br />June 7, 1999 <br />C <br />•Cletk of City Council <br />
