AN ORDINANCE <br />• AUTHORIZING THE LEASE OF REAL PROPERTY <br />FOR A DOWNTOWN VISITORS CENTER <br />AND FOR USE AND OCCUPANCY OF THE DOWNTOWN KIOSK <br />WHEREAS, on August 1, 2000 the City acquired, by lease ("Main Lease'), as the <br />lessee, certain premises located at 108 2nd Street, S.E., within the City of Charlottesville, for the <br />purpose of establishing a Visitors Center in the Downtown business district (hereinafter, <br />"Visitors Center Premises"); and <br />WHEREAS, City staff, the City Attorney and the City Manager have reviewed and <br />approved subleases to obtain tenants for the Visitors Center Premises ("Subleases"), and the <br />City proposes to lease, as lessor, the Visitors Center Premises to: the Charlottesville -Albemarle <br />Convention and Visitors Bureau (CACB), the Downtown Property Owners Council (DPOC), and <br />the Consortium for the Advancement of Art and Education (CARE) (collectively, "subtenants'); <br />and <br />WHEREAS, City staff has also arranged for a lease by the City, as lessor, of certain rea <br />property known as the Downtown Kiosk ("Kiosk lease"), for the purpose of utilizing this space in <br />a way that will provide revenue to the City, will provide for the maintenance and upkeep of the <br />kiosk, and will establish a distribution center for tourist materials, informational brochures and <br />literature; and <br />WHEREAS, the proposed Subleases and Kiosk lease establish uses and activities that <br />• will serve the best interests of the public, especially by promoting tourism and the various <br />resources and advantages of the City of Charlottesville; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Charlottesville, <br />Virginia, THAT: <br />The proposed Subleases and the Kiosk lease are hereby approved and ratified, and the <br />City Manager is authorized to execute the proposed Subleases and Kiosk lease, in the <br />form approved by the City Attorney; and <br />2. The City Manager is further authorized hereafter to sign any additional leases or <br />subleases, as may be necessary to ensure that the premises which are the subject of <br />the Main Lease and the Kiosk lease remain beneficially occupied, under terms and <br />conditions similar to those specified in the Subleases and the Kiosk lease, throughout <br />the authorized term(s) of the Main Lease and the Kiosk lease, without the need to return <br />to Council for additional public hearing(s) thereon. <br />Approved by Council <br />October 16, 2000 <br />(-w- <br />Qljbrk of City Council <br />0 <br />
