AN ORDINANCE <br />• TO AUTHORIZE CONVEYANCE <br />OF A PORTION OF THE SIXTH STREET, S.E. RIGHT-OF-WAY <br />TO J. S. AND FRANCES BARNETT <br />WHEREAS, J. S. and Frances Barnett own property designated as Parcels 371 and 372 <br />on City Tax Map 59, and wish to acquire a portion of the Sixth Street S.E. right-of-way which <br />abuts their property, as shown on a preliminary plat made by Steven Key, C.L.S. dated July 22, <br />2000 and labeled "Parcel A" (copy attached), containing approximately 11,975 square feet in area; <br />and <br />WHEREAS, in accordance with Virginia Code § 15.2-1800(B), a public hearing was held <br />to give the public an opportunity to comment on the possible sale of said City land; and <br />WHEREAS, the Assistant City Engineer and the Director of Planning and Community <br />Development have reviewed the plan and have no objections to the sale; now, therefore <br />BE IT ORDAINED by the Council of the City of Charlottesville, Virginia that the Mayor <br />is hereby authorized to execute a deed of quitclaim, in form approved by the City Attorney, <br />conveying the above -referenced right-of-way to J. S. and Frances Barnett for the purchase price <br />of $11,975. The City Attorney is hereby authorized to take whatever steps are necessary to effect <br />• the closing of said property conveyance. <br />BE IT FURTHER ORDAINED that, for and in consideration of this conveyance, the <br />Barnetts, or their successors in title, within a reasonable time after closing, will install and <br />maintain appropriate screening along portions of the Sixth Street side of Parcel A for a distance <br />of approximately 80 feet. Such planting shall at the minimum consist of 7 Yoshino Cherry Trees <br />8-10 feet in height. This promise shall be a covenant running with the land and shall survive <br />closing. <br />BE IT FURTHER ORDAINED that simultaneously with the above described conveyance, <br />the Barnetts will convey by deed to the City a pedestrian access easement approximately twenty <br />feet (20') in width across Parcel A and adjoining property owned by the Barnetts (City Tax Map <br />59-371). Said easement will be located next to the northern bank of Moore's Creek. <br />Approved by Council <br />October 16, 2000 <br />C rk of City Council <br />
